EOW of Delhi Police arrests two directors of JC World Hospitality

Economic Offences Wing, Delhi Police has arrested (1) Rita Dixit, w/o Dr Vijay Kant Dixit and (2) Dr Vijay Kant Dixit, r/o Jaypee Greens, Near Pari Chowk, Greater Noida, UP, both Directors of M/s JC World Hospitality Pvt Ltd, in case FIR No 27/20 of PS EOW.

Brief facts:-

The above mentioned case was registered on the complaint filed by Sh Dhirendra Nath and others, against a company namely M/s J C World Hospitality Private Limited and its Directors Dr Vijay Kant Dixit and Rita Dixit. It is stated that he had booked two shops vide Nos 114B & 114C in a project namely “J C World Mall” launched by the alleged company in the year 2014 and it is situated at Plot No. C1-K, Jaypee Greens Wish Town, Sector-128, NOIDA-201304, UP. He had paid a sum of Rs 1,75,88,330/- (Rs One Crore Seventy Five Lakh Eighty Eight Thousand Three Hundred and Thirty) to the alleged company in various installments. It was promised by the alleged company that possession of the units would be handed over in 30 months from the date of the allotment letter. It is alleged that the builder has not completed the construction work and no construction is going on at the site for the last 18 months. He has further alleged that despite having several meetings with the Directors of the alleged company, no purpose has been served and they are only giving false promises. It is alleged that the alleged company through its Directors have cheated a number of complainants/buyers on the pretext of providing shops in its project. The alleged company did not fulfill its promise and has diverted the funds of the buyers and misappropriated the funds. It was found that the alleged company neither returned the money nor completed the project. There are more than 30 complainants and total amount involved is Rs 12 Crores (approx).

Investigation:-

After preliminary enquiry, a case vide FIR No. 27/20 dated 15.02.2020 U/s 409/420/120-B IPC PS EOW, New Delhi was registered and investigation taken up under the leadership of DCP/EOW and close supervision of Ramesh Kumar Narang, ACP/EOW.

During investigation, it was found that the alleged company had launched the project in the year 2014 and had received money from the buyers/investors and promised to give the possession of their respective units within 30 months from the date of booking. NOIDA Authority has informed that the alleged company had applied for approval of building plan for the said project in the year 2015, which was returned to the alleged company with some objections and they were directed to provide relevant documents. However, the alleged company did not respond within the stipulated period and hence, their application for approval of Building Plan was rejected. It is also found that a sum of Rs 6 Crore from the buyer’s money was given to sister concern by the alleged company.

During investigation, it is found that accused persons are the Promoter/Director/Shareholder of the alleged company.

Arrest:-
A team led by ACP Ramesh Kumar Narang consisting of Insp. Nitin Kumar, SI Ajay Kumar, ASI Manju and Ct Vipin and under the overall supervision of Mohammed Ali, DCP/EOW conducted raid at the residence of the accused persons and apprehended both the accused persons. After interrogation, they were arrested. They were produced before CMM/New Delhi, Patiala House Court and Ld Court has granted two days police custody.
